Consumer/ Residential Terms of sale
These terms apply when you purchase Brass Monkey Products for domestic (non‑commercial) use. They operate in addition to, and do not affect, your statutory rights.
1. Definitions
“Brass Monkey” means Brass Monkey Health Ltd. “Product” means Brass Monkey residential ice baths, plunges, barrels and associated chillers and accessories supplied by us. “Consumer” means an individual purchasing wholly or mainly for personal, domestic use and not for business purposes. “Commercial / Pro” means any business, professional, public or high‑throughput use (including gyms, spas, studios, hotels and clubs). “Order” means your order for Products. “Order Acceptance” means the point at which Brass Monkey has received payment in full for the Order, unless otherwise expressly agreed in writing.

3. Ordering Process
- Acceptance. Your Order is an offer to buy. An Order is only accepted by Brass Monkey once payment in full has been received, unless otherwise expressly agreed in writing. We confirm acceptance by issuing an order confirmation or invoice after receipt of payment.
- Specification. Please check the specification and finish options carefully before purchase. Where applicable, drawings or site measurements you supply must be accurate.
- Bespoke/Customised Products. Where Products are customised (dimensions, finishes, integrations, branding or other non‑standard specifications), they are “Bespoke Products”. Special cancellation/return rules apply (see Section 7).
4. Pricing, Taxes & Payment
- Prices. Prices are as shown at checkout or in your quote/invoice. Unless stated otherwise, prices are inclusive of UK VAT and exclusive of delivery/installation.
- International orders. For deliveries outside the UK, you are responsible for any import duties, taxes, and other charges imposed by customs or local authorities unless expressly stated otherwise in writing. These are not collected by Brass Monkey. We are not liable for providing or guaranteeing the accuracy of any estimate of such charges.
- Errors. We may correct obvious pricing or description errors. If a correction affects your Order, we will notify you and you may cancel for a full refund before shipment/installation.
- Payment. We accept the payment methods shown at checkout or stated in your invoice. Payment is due as specified in your Order confirmation or invoice.
5. Delivery, Risk & Title
- Delivery windows. Any delivery date given is an estimate. We’ll keep you updated if timings change.
- Risk. Risk in the Products passes to you on delivery to the address you provide.
- Title. Ownership passes on our receipt of payment in full (cleared funds) for the Products and any associated services.
- Access. You must ensure reasonable access for delivery and, if applicable, installation (doorways, routes, floor loadings, clearances and utilities).
- Late cancellation / failed visit. Any pre‑agreed installation or delivery appointment cancelled by you with less than 2 business days' notice, or if we arrive and are unable to safely carry out the works due to site conditions, will incur a cancellation or re‑booking fee. 6. Inspection on Delivery & Damage Reporting
Post‑Delivery Inspection and Damage Reporting
- Visible loss or damage. If Products are visibly damaged, incomplete, or not in accordance with the delivery note at the time of delivery, please note this on the delivery record and notify Brass Monkey via the Support page within 3 calendar days of delivery.
- Concealed loss or damage. If damage or shortages are not apparent at delivery, please notify Brass Monkey within 7 calendar days of delivery.
- Failure to notify. Failure to notify within these timeframes may affect our ability to investigate or make a claim against the carrier, and may limit the remedies available. This does not affect your statutory rights relating to faulty goods.
7. Consumer Right to Cancel (Distance/Online)
- 14‑day right. If you purchase as a Consumer online/at distance, you may cancel within 14 days of delivery without giving any reason, and receive a refund of the Product price and the standard outbound delivery charge.
- Returns. You must send back the Products without undue delay and in any event within 14 days of telling us you wish to cancel. You bear the direct cost of returning the Products. You are responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
- Bespoke Products. The 14‑day cancellation right does not apply to Bespoke/Customised Products that are made to your specifications or clearly personalised, except where the Product is faulty (see Section 9).
- Services commenced on request. If you ask us to begin services (e.g., installation) within the cancellation period, you may need to pay reasonable costs for work performed up to the point of cancellation.
8. Making a Return
- Contact us first. You must contact Brass Monkey via the Support page before returning any Product to obtain a Returns Authorisation (RA).
- Return address & instructions. We will confirm the return address and provide instructions (including recommended packaging and handling).
- Packaging. Products must be packaged to prevent damage in transit. You are responsible for any damage that occurs prior to our receipt.
- Proof of return / tracking. Use a trackable service and retain proof of delivery. We are not liable for lost return shipments without proof of delivery.
- Inspection & condition. Returned Products will be inspected on receipt. Deductions may apply for any loss in value due to handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
- Refund method. Refunds will be made to the original payment method unless otherwise agreed.
9. Returns & Refunds
- Condition. Where possible, please return Products in their original packaging with all accessories and manuals. (Original packaging is not a requirement to exercise your rights.)
- Accessories & apparel. Accessories (including insulated toppers, covers, apparel and similar non‑fixed items) may be returned under the Consumer Right to Cancel provided they are unused and in their original condition/packaging. For hygiene reasons, we cannot accept returns of apparel or accessories that have been used or worn unless faulty.
- Refund timing. We will process refunds without undue delay and, in any event, within 14 days of receiving the returned Products (or evidence of return).
10. Faulty Goods (Consumer Rights)
- Your legal rights. You have rights in relation to goods that are faulty or not as described. These include a short‑term right to reject, repair or replacement, or a price reduction in appropriate cases under UK consumer law.
- Initial period. If a fault appears within the initial period after delivery, please contact us promptly so we can assess and remedy. If a fault appears within six months, it is presumed to have been present at delivery unless we show otherwise.
- Remedies. We may repair or replace within a reasonable time and with minimal inconvenience. If that is not possible or fails, you may be entitled to a price reduction or final right to reject.
11. Installation & Site Requirements
- Compliance. Products must be installed and commissioned in accordance with our guidance (including electrical supply, ventilation, drainage, access and water management).
- Third‑party works. Any third‑party works (e.g., builders/electricians/plumbers) are your responsibility unless expressly provided by us in writing.
12. Maintenance Obligations
- Routine maintenance. You must operate and maintain the Product in line with our instructions, including filter cleaning/replacement and keeping water chemistry within recommended parameters.
- Record‑keeping. We recommend keeping basic maintenance records (dates, actions taken). This helps us diagnose issues and may be requested during a warranty assessment.
13. Warranty & Post‑Warranty Service
- Residential Warranty. Your Product is covered by Brass Monkey’s Residential Warranty as set out at Warranty Information. Service scope: within mainland UK, warranty service may include parts and labour; outside mainland UK, we will supply parts with remote technical guidance for fitting by an approved technician.
- Authorised service. Warranty repairs must be carried out by Brass Monkey or an authorised service agent. Use of non‑genuine parts or unapproved modifications may void the warranty.
- Post‑warranty service. After the warranty period, service is available on a chargeable basis. See current rates at Service & Call‑Out Charges.
14. Consumables & Exclusions
Consumables are not covered by the warranty and may require routine replacement. Consumables include, without limitation: insulated toppers, filters, O‑rings, seals, gaskets, sacrificial anodes, and UV bulbs/lamps. Warranty does not cover damage from improper water chemistry, lack of maintenance, misuse/abuse, unauthorised modifications or repairs, power supply issues, or cosmetic wear and tear not affecting function (see Warranty Information).
15. Limitation of Liability
- No exclusion for certain losses. Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be limited by law.
- Consequential losses. We are not responsible for indirect or consequential loss (including loss of use or profit) where exclusion is permitted by law. Your statutory rights as a Consumer remain unaffected.
16. Force Majeure
We are not liable for delay or failure to perform due to events beyond our reasonable control (including but not limited to acts of God, extreme weather, epidemic, industrial disputes, transport/distribution interruptions, or utility outages). We will take reasonable steps to minimise the impact and resume performance as soon as practicable.

18. Governing Law & Jurisdiction
These terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of England & Wales. If you are a Consumer resident in the UK, you may also bring proceedings in your local UK jurisdiction.
