Commercial Terms of Sale
These Terms apply when Products are purchased for Commercial / Pro use.
1. Definitions
“Brass Monkey” means Brass Monkey Health Ltd. “Product” means Brass Monkey commercial ice baths, plunges, barrels and associated chillers and accessories. “Commercial / Pro” means any business, professional, public or high‑throughput use (including gyms, spas, studios, hotels and clubs). “Order” means your commercial order for Products. “Order Acceptance” means the point at which Brass Monkey has received payment in full for the Order, unless otherwise expressly agreed in writing.
2. Orders & Specifications
- Acceptance. Orders are subject to written acceptance. An Order is only accepted by Brass Monkey once payment in full has been received, unless otherwise expressly agreed in writing. We may decline or propose reasonable changes required by safety or compliance.
- Bespoke Products. Custom sizes/finishes/integrations and branding are “Bespoke Products”. Cancellations/returns do not apply except for defects (see Warranty).
- Accuracy. You are responsible for accurate drawings/site measurements where supplied by you.
3. Pricing, Taxes & Payment
- Prices. As stated in quotes/invoices; exclusive of VAT unless stated; exclusive of delivery/installation unless stated.
- International orders. For deliveries outside the UK, you are responsible for any import duties, taxes and other charges unless expressly stated otherwise in writing. These are not collected by Brass Monkey. We are not liable for providing or guaranteeing the accuracy of any estimate of such charges.
- Payment terms. As per invoice. We may suspend performance for non‑payment or suspected fraud.
- Errors. We may correct obvious pricing/description errors; you may cancel before shipment/installation if affected.
4. Delivery, Risk & Title
- Delivery windows. Dates are estimates; we will keep you updated.
- Risk & Title. Risk passes on delivery. Title passes on receipt of all sums due (cleared funds).
5. Inspection & Damage Reporting
Post‑Delivery Inspection and Damage Reporting
- Visible loss or damage. If Products are visibly damaged, incomplete, or not in accordance with the delivery note at the time of delivery, you must note this on the delivery record and notify Brass Monkey via the Support page within 3 calendar days of delivery.
- Concealed loss or damage. If damage or shortages are not apparent at delivery, you must notify Brass Monkey within 7 calendar days of delivery.
- Failure to notify. Failure to notify within these timeframes may affect our ability to investigate or make a claim against the carrier, and may limit the remedies available.
6. Access, Appointments & Cancellations
- Access. You must ensure safe access, clear working areas and necessary utilities for delivery/installation.
- Late cancellation / failed visit. Any pre‑agreed installation or delivery appointment cancelled by you with less than 2 business days' notice, or if we arrive and cannot safely proceed due to site conditions, will incur a cancellation or re‑booking fee. 7. Installation & Site Requirements
- Compliance. Installation/commissioning must follow our specifications (power, ventilation, drainage, structural capacity, water management).
- Third‑party works. Any third‑party works are your responsibility unless expressly included in writing.
8. Maintenance & Records
- Routine maintenance. Operate and maintain per our instructions (including filter cleaning/replacement and water chemistry within recommended parameters).
- Record‑keeping. Keep basic maintenance logs; these may be requested for warranty assessment.
9. Warranty & Post‑Warranty Service
- Commercial / Pro Warranty. 12‑month Limited Warranty (materials and workmanship) from delivery. Service scope: within mainland UK, parts and labour may be included; outside mainland UK, we supply parts with remote technical guidance for fitting by an approved technician.
- Authorised service. Repairs must be carried out by Brass Monkey or an authorised service agent. Use of non‑genuine parts or unapproved modifications voids the warranty.
- Post‑warranty service. Chargeable per our current rates: Service & Call‑Out Charges.

10. Consumables & Exclusions
Consumables are not covered by the warranty and require routine replacement. Consumables include, without limitation: insulated toppers, filters, O‑rings, seals, UV bulbs/lamps. Warranty does not apply where voided under the exclusions listed in the Warranty (improper chemistry, lack of maintenance, misuse/abuse, unauthorised modifications/repairs, power supply issues, cosmetic wear & tear, transport/site damage).
11. Making a Return
- Authorisation required. Returns (other than statutory faulty‑goods remedies) require prior written approval and a Returns Authorisation (RA). Contact us via the Support page before sending anything back.
- Address & instructions. We will confirm the return address and packaging/handling instructions.
- Packaging. Products must be packaged to prevent damage in transit; you are responsible for any damage that occurs prior to our receipt.
- Proof of return. Use a trackable service and retain proof of delivery. We are not liable for lost return shipments without proof of delivery.
- Inspection & outcome. Returned Products will be inspected on receipt. Where a discretionary return is agreed, refunds/credits may be reduced to reflect damage or use.
- Refund method. Any refund/credit (where agreed) will be made to the original payment method or as account credit, unless otherwise agreed in writing.
12. Limitation of Liability
- Nothing limits/excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or where unlawful to limit.
- We are not liable for indirect or consequential loss (including loss of profit/revenue), loss of business, contracts or goodwill, or special damages, to the fullest extent permitted by law.
13. Governing Law & Jurisdiction
English law applies (England & Wales jurisdiction).
